Jet Airways Founder Naresh Goyal's Judicial Custody Extended: A Deep Dive into the Case

Jet Airways, once a prominent name in the Indian aviation industry, has been embroiled in a legal battle for alleged financial irregularities and fraud. Naresh Goyal, the founder of Jet Airways, has recently faced an extension of his judicial custody by 14 days. Jet Airways (India) Limited, along with Naresh Goyal, his wife Anita Naresh Goyal, Gaurang Ananda Shetty, and unknown Public Servant(s) and Private Person(s), were named as accused in the FIR filed by the chief general manager of recovery and legal section at Canara Bank. The complaint alleged criminal conspiracy, criminal breach of trust, and criminal misconduct, causing a wrongful loss of Rs 538.62 crore to the bank.


The Allegations and Investigations


The Enforcement Directorate (ED), along with other central agencies such as the Central Bureau of Investigation (CBI), Income Tax (IT) department, and Serious Fraud Investigation Office (SFIO), has been probing the alleged irregularities in the affairs of Jet Airways and individuals associated with it.

A forensic audit conducted by EY revealed several financial irregularities within Jet Airways. The audit highlighted that Jet Airways India Limited (JIL) had made payments of ₹1,410.41 crore to related parties as commission expenses. Additionally, expenses of general selling agents (GSA) amounting to Rs 403.27 crore were paid by JIL, which deviated from the GSA agreement. The complaint also alleges that funds were siphoned off through Jet Lite (India) Ltd (JLL), a subsidiary, by making advances and subsequently writing them off through provisions.

Furthermore, JIL allegedly transferred funds amounting to Rs 2,547.83 crore to JLL as a loan, which remains unpaid. Another allegation suggests that over Rs 400 crore were siphoned off through payments made to professional and consultancy expenses.

The Legal Proceedings


In February, the Bombay High Court quashed the ED's money laundering case against Naresh Goyal and his wife Anita Naresh Goyal due to the lack of a predicate offense. However, the court observed that if any fresh case is registered by any law enforcement agency, the ED could initiate a probe.

Following the enforcement case information report (ECIR), the ED conducted searches in Mumbai and Delhi, targeting the Goyals and the erstwhile auditor of the airline. Naresh Goyal was subsequently arrested on September 1, and the ED sought a 14-day custody for further investigations.

A special PMLA Court in Mumbai has recently extended Naresh Goyal's judicial custody by 14 days. The decision was made after his ED custody ended, and he was produced before the court. Naresh Goyal is being held under the Prevention of Money Laundering Act (PMLA), which was registered by the CBI.
